EAVE NETWORK USER ACCOUNT TERMS AND CONDITIONS OF USE

Information of the company that manages the services 

The services are provided by Les Entrepreneurs de l'Audiovisuel Européen a.s.b.l. (hereinafter referred to as “EAVE”), a Luxembourgish non-profit organisation with registered address at 238c rue de Luxembourg, L-8070 Bertrange, Luxembourg with Tax Identification Number F741 - Mle. Lux : 2004 61 01953. 

European Audiovisual Entrepreneurs, EAVE, is a professional training, project development and networking organization for audiovisual producers. Our objectives are to provide professional training opportunities and to bring producers from different regions of the world together with the aim of facilitating co-production relationships.
The current general terms and conditions of use aim to define the terms and conditions under which a User can benefit from the Site’s Services.

It is agreed that the use of the Site implies the Users’ full and complete approval of the general terms and conditions of use. If a User does not accept the general terms and conditions of use, he/she shall cease to use the Services and contact EAVE at webmaster@eave.org for the deletion of their EAVE Network User account.

These general terms and conditions of use ("General Terms and Conditions of Use") shall govern the use of the website www.eave.org and related platform ("Website"), which belongs to EAVE. The purpose is to provide information about the activity of the organisation and enable the use of the services offered by EAVE (“Service” or “Services”), consisting in an online database and contacts of EAVE network members, subscription to the EAVE monthly newsletters about the network users success stories and special opportunities for EAVE Network Users for attending festivals and markets on preferential terms, as well as a resource area with expert presentations, videos of EAVE sessions and useful links and resources for the industry.


1. ACCESS AND USE OF THE SERVICES

1.1. Access to the Services 

1.1.1.   By applying and upon selection to one of the EAVE training programmes, or by appointment as a trainer for one of our workshops, as an EAVE national coordinator, EAVE board or team member, you expressly acknowledge our collection, use, disclosure and retention of your information as described in the EAVE Privacy Policy and in the EAVE Terms of Use.

1.1.2.   Access to Services is strictly limited to EAVE Network Users, participants and graduates of at least one EAVE training programmes (also known as EAVE producers), the trainers at such workshops, EAVE national coordinators, board and EAVE team members. The EAVE Network Users profiles are set up by EAVE upon the participation confirmation of selected candidates and is based on the contact information provided by the participants in their application forms. Trainer, national coordinators, board and team members Network User profiles are based on the information provided by the subjects, upon being contracted for a workshop or upon appointment.

1.1.3.   All EAVE Network Users receive an e-mail by EAVE with log-in instructions which will allow them to change their log-in data and modify their contact details. 

1.1.4.   All EAVE Network Users will be automatically subscribed to the EAVE monthly newsletters detailing the network users success stories and special opportunities for EAVE Network Users for attending festivals and markets on preferential terms. EAVE Network Users have the possibility to unsubscribe from such communication at any time.

1.2. Login and passwords

1.2.1.  The EAVE Network User log-in information shall be personal and non-transferable. The User shall inform EAVE of any changes to his or her personal data and is responsible for preventing unauthorized access and/or use of the log-in information by a third party on his or her behalf. In addition, the User shall be solely responsible for the choice, loss, theft or unauthorized use of any code or password, and the consequences derived therefrom.  

1.2.2.  If an EAVE Network User has reasons to believe that his/her Login and/or password have come to the knowledge of unauthorized Third Parties or that Third Parties use the Services thanks to his Login and password, the EAVE Network User must immediately modify the Login and password required to access his Account or contact webmaster@eave.org for a reset of the log-in information.

1.2.3.  In case of loss of its Login and/or password, the EAVE Network User registered to an Account can ask to reset his "password" in the login space. User will be asked for the email address inked to the account. User will receive a hypertext link from which User will be allowed to generate a new password. For assistance the EAVE Network User may contact webmaster@eave.org. 

1.3. EAVE Network User Account Functions

1.3.1.  The EAVE Network User Account is an interface enabling a Subscriber to access to the website`s restricted resource area and the EAVE network database with contacts of all EAVE producers, trainers, national coordinators, board and team members. .

1.3.2.  The Account allows EAVE Network User to access the Services of the Site and to manage her/his personal data.

1.4.    Termination of your EAVE Network User Account

1.4.1.   You may delete your EAVE Network User account by contacting webmaster@eave.org and you may opt out of receiving any newsletters from EAVE at any time by unsubscribing from this services via the unsubscribe link at the bottom of all EAVE newsletter or by contacting webmaster@eave.org. Deleting your EAVE Network User account will cause all the contact data in the account to be permanently deleted from our systems within a reasonable time period, as permitted by law and will disable your access to any other services that require an EAVE Network User account. We will respond to any such request, and any appropriate request to access, correct, update or delete your personal information within the time period specified by law (if applicable) or without excessive delay. We will promptly fulfil requests to delete personal data unless the request is not technically feasible or such data is required to be retained by law (in which case we will block access to such data, if required by law).

  

2. PRIVACY POLICY

2.1.   When the User provides personal data to EAVE, including during registration for a training programme or by updating their personal data under the “My Profile” section of the website or by informing the EAVE team of changes to the contact details, the Privacy Policy shall apply, which must be previously read and accepted by the User. 

 

3. LIMITATION OF LIABILITY

3.1.   You understand and agree that EAVE will not be liable to you for any direct, indirect, accidental, consecutive or special damages related to the access or the use of the Site and the Services or suffered consequently to them, including, but without limiting to, any loss or damage occurred by viruses affecting the computer equipment of the Subscribers and Users or resulting from an information obtained through the Site, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from your use or access of, or inability to use or access, the service or the content.

3.2.   EAVE does not warrant that the Site and Services will correspond to the requirements of the Users or that the use by them will be uninterrupted and free of any error. EAVE does not warranty that all Content is correct, accurate, exhaustive or truthful.

For any corrections on your personal data please log-in and access the “MY PROFILE” page and edit the information listed. For assistance on this matter, please contact webmaster@eave.org.           

 

4. SUSPENSION OF ACCESS 

4.1.   Please report problems and policy violations to us by contacting webmaster@eave.org. We reserve the right, but have no obligation, to remove any Content from the Service at any time in our discretion. 

4.2.   In addition, without limiting other remedies, we may, in our sole discretion, limit, suspend, or terminate the Service and EAVE Network User Accounts, prohibit access to the Service or the Content, and take technical and legal steps to keep users from using the Service or the Content, if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our policies (for example, and without limitation, circumventing temporary or permanent suspensions or harassing our employees or other users). 

 

5. APPLICABLE LAW AND JURISDICTION 

5.1.   The access to and use of the Services shall be governed and construed in accordance with Luxembourgish law. 

5.2.   Any dispute that may arise from or in connection to EAVE and the Services users shall be settled in the Courts of Luxembourg. To this end, the parties expressly renounce their own jurisdiction and submit to the jurisdiction of the Courts of Luxembourg.

 

 

EAVE Privacy Policy For Network User Accounts

1.   PARTIES

1.1.   This Privacy Policy describes how Les Entrepreneurs de l'Audiovisuel Européen a.s.b.l. (“EAVE”, “we”, or “us”) collects, uses, stores, shares and protects your information in connection with services offered by EAVE as a data controller and/or processor including, but not limited to, services provided at or using the domain www.eave.com (the “Site”); tools or applications including, but not limited to, mobile and other software applications related to the Site (the “Applications”); and images, text, playlists, metadata, and other material available through the Service (the “Content”) (collectively, the “Service”). 

1.2.   This Privacy Policy applies when you (“you”, “User” or “EAVE Network User”) access, log-in to the EAVE website. For the purposes of this Privacy Policy, a “User” is a person who takes part in an EAVE workshop as a participant or as a trainer, EAVE national coordinators, board and EAVE team members and receives access to the EAVE Restricted Resource Area via an online profile.

1.3.   This Privacy Policy is part of, and is governed by, the terms and conditions set forth in the EAVE Terms of Use.

 

2.   AGREEMENT TO TERMS OF PRIVACY POLICY

2.1.   By applying and upon selection to one of the EAVE training programmes, or by appointment as a trainer for one of our workshops, as an EAVE national coordinator, EAVE board or team member, you expressly acknowledge our collection, use, disclosure and retention of your information as described in this Privacy Policy and in the EAVE Terms of Use.

 

3.   CHANGES TO THE PRIVACY POLICY

3.1.   We may amend this Privacy Policy from time to time. We may post any material changes to this Privacy Policy on the Site with a notice advising of the changes in advance of the effective date of the changes. We may also notify you of material changes to this Privacy Policy, before the effective date of the changes, by sending an email or in another conspicuous manner reasonably designed to notify you. If you do not agree to the new Privacy Policy, you may terminate using the Service within the applicable thirty (30) day period and you will not be bound by the new terms. For that please contact webmaster@eave.org. When we post changes to our Privacy Policy, we will revise the "Last Updated" date at the top of the Privacy Policy.

 

4.   RIGHTS TO ACCESS, RECTIFICATION OR ERASURE, RESTRICTION AND OBJECTION, OF PROCESSING

4.1.   You have the right to access, rectification, opposition, erasure (“right to be forgotten”), and right to restriction of processing of your personal data by directing any such requests to EAVE (with Tax Identification Number F741 - Mle. Lux : 2004 61 01953) registered at address 238c rue de Luxembourg, L-8070 Bertrange, Luxembourg. In order to make things easier for you, and without prejudice to the legal requirements EAVE must comply with under the laws, EAVE allows you to exercise the above-mentioned rights by contacting webmaster@eave.org

 

5.   PERSONAL INFORMATION ABOUT USERS

The information we receive from Users and how we handle it differs, as set out below.

5.1.   As an EAVE Network User, we collect information relating to you and your use of our Services from a variety of sources:

5.1.1.   Information we collect directly from the User

a)     Registration information: information you provide to us when you apply for one of the EAVE trainings, after being contracted as a trainer for one of EAVE`s workshops, or after being appointed as an EAVE national coordinator, board or team member.

b)     “My Profile” settings: you can view and edit personal details on “My Profile” settings.

c)     Other data you want to share: We may collect your personal information or data if you submit it to us in other contexts. For example, if you provide us with a testimonial/quote, photos, CV, success stories and track record.

5.1.2.   Information we collect about the Network User indirectly or passively when interacting with us 

a)     Referral data: if the User arrives at the EAVE website from an external source (such as a link on another website), we record information about the source that referred the User to us.

b)     Information from cookies and page tags: EAVE uses third party tracking services that employ cookies and page tags (also known as web beacons or web bugs) to collect aggregated and anonymized data about visitors to our websites. This data may include usage and User statistics. You can obtain full information about our cookie policy, and third party services used on the website: Vimeo above.

5.2.   EAVE’s obligations when processing User data

For the processing of Users data, EAVE undertakes to fulfil the following obligations:

a)  To maintain the duty of secrecy with respect to the personal data handled, even after the termination of the workshop or appointment, and to ensure that their employees have committed to maintain the confidentiality of the personal data processed.

b) To keep under their control and custody the personal data to which they have access in relation with the provision of the Service, and to not disclose them, neither transfer or otherwise communicate them, to persons unrelated with the provision of the Service covered by this Agreement.

In any case, access to the data made by natural persons who render their services to EAVE, acting within the organizational framework, is authorized. In addition, access to the data is granted to companies and professionals that the Data Processor has hired in their internal organizational framework in order to provide general or maintenance services (computer services, consulting, audits, etc.).

c)  To notify the User, without undue delay, of any personal data security breaches and notify the competent Control Authority and, if applicable, to the interested parties of the security breaches that occur.

 

6.   PURPOSES AND LEGITIMATE BASIS OF DATA PROCESSING

6.1.   INFORMATION PURPOSES OF PROCESSING

6.1.1 .  We use the information we collect from you to perform the services requested in connection with the “EAVE Account” described in the Terms of Use.

6.1.2.   We also use your information to review, investigate and analyze how to improve the services provided. We may also collect and analyze your data to monitor, maintain and improve our services and features.

6.1.3.   We may internally perform statistical and other analysis on information we receive from you and on information we may collect to analyze and measure user behavior and trends, to understand how people use our services, in order to improve and optimize our performance of such services, and to monitor, troubleshoot and improve our services, including to help us evaluate or devise new features. 

6.1.4.   We’ll be sending you EAVE Monthly Newsletters and EAVE Network Member Special Opportunities by email and similar means of electronic communication as part of providing relevant content for our network. EAVE Network Users have the possibility to unsubscribe from such communication at any time.

6.1.5.   We do not sell your profile data to third parties. We share your status of “EAVE Producer”, , EAVE Trainer”, EAVE National Coordinator”, EAVE Board Member”, EAVE Team Member”  with other industry actors (markets and festivals, national film agencies, Creative Europe etc.) who help us to provide our services to you, in which case those third parties are required to comply with our privacy policy and any other adequate technical and organizational measures to keep your information confidential and to use it only for the purpose of providing their services to your benefit and pursuant to the applicable privacy legislation in the EU.

EAVE is based in the EU and complies with the GDPR framework as set forth by the EU regarding the collection, use, and retention of personal data from EU member countries. If you are located outside the EU and choose to use the Service or provide your information to us, please note that your information may be transferred, processed and stored by our service providers in other non-EU countries. Privacy laws of the European Union and third countries may not be as protective as those in your jurisdiction.

6.1.6.   Your data is not disclosed to any third party except (I) for reporting purposes to EAVE financiers, such as the European Commission, the Film Fund Luxembourg etc., (II) providing access to the restricted resource area, and for which EAVE collaborates with third parties, (III) the online EAVE database with contact information of EAVE producers, which is closed to the public and only accessible to EAVE Network Users after logging in, for which EAVE collaborates with third parties, (IV) when we have your permission, (V) when it is required by a competent authority in the exercise of its duties (for example in order to investigate, prevent or take action regarding illegal activities) or (VI) as otherwise required by law.

EAVE Network User names; company name; position in the company; website; and for EAVE producers and trainers, the year and EAVE workshop in which they have participated in, are visible to the public.

6.1.7.   We do not use your contact data other than as described in this Privacy Policy and the Terms of Use.

6.2.   LEGITIMATE BASIS OF PROCESSING

EAVE uses of your data for the purposes described above is based on the following legitimate basis: 

6.2.1.   If you are a User, EAVE has a legitimate interest to use your data in order to maintain the relation with you as an EAVE PRODUCER, EAVE TRAINER, EAVE NATIONAL COORDINATOR, EAVE BOARD and EAVE TEAM MEMBER and NETWORK USER and support your career and professional development. EAVE processes data in a reasonably expected way and with minimal privacy impact. EAVE might update the integrating new procedures compliant with upcoming ePrivacy regulations, such as asking for your consent to our future newsletter communication and direct marketing. When we post changes to our Privacy Policy, we will revise the "Last Updated" date at the top of the Privacy Policy.

a) The EAVE online database constitutes a networking tool for the EAVE network of producers, trainers, EAVE national coordinators, EAVE board and team members and contact information is only available to logged-in EAVE Network Users.

b) The EAVE online database profile gives access to the EAVE restricted resource area.

c) EAVE staff and collaborators regularly screens public industry communications and news for EAVE Network Users selected at festivals and markets, awards, nominations and funding received, as well as for theatrical releases by EAVE Network Users. EAVE compiles such information with minimal privacy impact into monthly newsletters and social media posts. If you find that any information is incomplete, incorrect or you would like it to be deleted please contact webmaster@eave.org

d) Contact information, project information, track record and statistical information among other, are disclosed as part of reports to EAVE`s main financiers such as, but not necessarily limited to, the European Commission and Film Fund Luxembourg.

6.2.2.   EAVE is entitled by law to use your data for direct marketing purposes, in order to send you commercial communications related with EAVE services which are similar to the Services, since legislation on data privacy recognizes direct marketing to clients as a legitimate interest (CDPR, art 47) of use of personal data, and legislation on information society services expressly allows EAVE to send you commercial communications by electronic means, provided that they are related with products or services which are similar to the Services. In any case, you are entitled to ask us, now or at any moment, not to send you any commercial communications. If you don’t want us to send you commercial communications, you can do it, now or at any moment, by unsubscribing from our newsletters (will an easy and free-of-charge way for you to unsubscribe by clicking the unsubscribe link at the end of any of our newsletters) or by contacting webmaster@eave.org.

EAVE might update the Privacy Policy by integrating upcoming/new procedures compliant with upcoming ePrivacy regulations, such as asking for your consent to our future newsletter communication and direct marketing.

 

7.      COOKIES

7.1.   A cookie is a small string of information that the website you visit transfers to your computer for identification purposes. Cookies can be used to follow your activity throughout the EAVE Service and that information helps us to understand your preferences and improve your experience.

8.     CANCELING YOUR ACCOUNT, OPTING OUT OF EMAIL, AND MODIFYING PERSONAL INFORMATION

8.1.  You may delete your EAVE Network User account by contacting webmaster@eave.org and you may opt out of receiving any newsletters from EAVE at any time by unsubscribing from this services via the unsubscribe link at the bottom of all EAVE newsletter or by contacting webmaster@eave.org. Deleting your EAVE Network User account will cause all the contact data in the account to be permanently deleted from our systems within a reasonable time period, as permitted by law and will disable your access to any other services that require an EAVE Network User account. We will respond to any such request, and any appropriate request to access, correct, update or delete your personal information within the time period specified by law (if applicable) or without excessive delay. We will promptly fulfil requests to delete personal data unless the request is not technically feasible or such data is required to be retained by law (in which case we will block access to such data, if required by law).

8.2.   You may modify your personal information by logging in and visiting your settings at “MY PROFILE” page.

8.3.   We encourage you promptly to update your personal information when it changes.

 

9.       RETENTION OF YOUR INFORMATION

9.1.   We retain information for EAVE Network Users as long as it is necessary and relevant for our operations. In addition, we may retain information from closed accounts to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce the EAVE Terms of Service and take other actions permitted by law.

9.2.   The information we retain about you will be handled in accordance with this Privacy Policy during the maximum terms permitted by law, and will exclusively be used for the purposes described in section 9.1 above.

 

10.   HOW TO CONTACT US & COMPLAINTS

10.1.  If you consider that any use of your data might breach any of your rights, you can lodge a complaint at any time by contacting webmaster@eave.org.
